LAS CRUCES, N.M. — Former New Mexico State University Athletic Director Mario Moccia filed a wrongful termination lawsuit against the NMSU Board of Regents Friday, Nov. 21, almost one year after being fired.
In one of his first acts on the job new NMSU president Valerio Ferme, relieved Moccia of his duties Jan. 2, 2025. This followed the release of the New Mexico attorney general’s investigation of hazing NMSU’s 2022-23 men’s basketball team, as well as a deadly shooting involving Aggie basketball alumni Mike Peake. The investigation came after an accusation of sexual hazing was brought forward by a former student team manager in 2023. In February 2023, Moccia fired then-men’s head basketball coach Greg Heiar, and canceled the final six games of that season.
The current lawsuit argues that Moccia’s contract was breached, and he is seeking $1.4 million in remaining contract payments, benefits, earned incentive compensation, attorney fees, court costs and damages.
Moccia’s attorney, Nicholas Hart, said the university’s decision to fire Moccia was not done correctly.
“The university ignored the facts and acted out of political expediency, rather than abiding by Mr. Moccia’s contract,” Hart said.
Both Moccia and Hart have been contacted by other outlets for comment, but have not yet responded. A spokesperson from NMSU said the lawsuit has yet to be served to the university officially and cannot comment.
